On September 17, 2025, the Company filed a complaint against SpyGlass Pharma, Inc. (SpyGlass) in the United States District Court for the Central District of California and its Vice President of Clinical Research, Long Doan (Case No. 8:25-cv-02105). Specifically, the complaint alleges that former Glaukos senior clinical leader Long Doan and competitor SpyGlass engaged in the mass theft and continuing exploitation of more than 11,000 confidential and trade secret files—part of over 13,000 Company documents Mr. Doan surreptitiously uploaded to his personal Google Drive after accepting SpyGlass’s offer to shortcut SpyGlass’s clinical, regulatory, and operational efforts and inflict irreparable competitive harm on the Company. On December 11, 2025, after finding that the Company was likely to prevail on the merits of the case and is at risk of irreparable harm, the Court entered an injunction against both SpyGlass and Mr. Doan and in favor of the Company. In March 2026, the Company filed its First Amended Complaint (FAC), alleging violations of the United States Defend Trade Secrets Act against both Doan and SpyGlass; alleging breach of contract, fraud, breach of duty of loyalty, and violation of the California Computer Fraud and Abuse Act (CFAA) against Doan; and inducement of breach of contract against SpyGlass. Both Defendants moved to dismiss all claims in the FAC on April 9, 2026. The Court denied both motions in their entirety on July 14, 2026. SpyGlass filed its Answer and Counterclaims on May 22, 2026, and an Amended Answer and Counterclaims on July 6, 2026. In its counterclaims, SpyGlass alleges (1) intentional interference with contractual relations; (2) intentional interference with prospective economic advantage; and (3) unfair competition under Bus. & Prof. Code § 17200. The Company moved to dismiss all of SpyGlass’s counterclaims on July 20, 2026, the hearing for which is scheduled on September 28, 2026. Doan filed his Answer and Counterclaims on July 17, 2026. Doan asserts: (1) unfair competition under Bus. & Prof. Code §§ 17200, 16600.1, and 16600.5; (2) breach of contract; and (3) breach of the implied covenant of good faith and fair dealing. The trial date is now set for January 26, 2027.
